I’m not sure how this is Bree’s fault? Sure, she could have gone for a sneak-attack assassination attempt instead of attempting to first negotiate, but that guy has a pretty big healing factor and it’s doubtful he’d have been successfully one-shot-killed.
A villain like this has to have some plot armor. Imagine Star Wars if Darth Vader was killed right at the start of A New Hope by the corvette captain pulling a hidden gun during his interrogation. Would be lame, right?

Not at all. Could she have? Probably yes! Instead of reading the scroll of “I prepared Explosive Runes this morning” she could’ve eviscerated Cherek (we’ve seen how her blade worked on Mindripper, pretty vorpal) and vanish.
The point you are missing is that it’s not Bree who’s killing people here. It’s this guy. If Bree wasn’t around, this guy would still be here killing people. Therefore you cannot blame it on Bree. Pretty simple.
You can also blame it on the cook for not having sneaked out to poison Cherek’s meal. Or on Brother Maynard for not having given them a Holy Hand Grenade.
None of these people were in any way entitled a successful infiltration mission from Bree. They didn’t even want to break their bridge! By destroying it, Bree delayed the orcs and forced Cherek to negotiate with one of his captives and release some of their prisoners. Bree’s action so far have been a net benefit even if it wasn’t a flawless performance.

It’s precisely the distinction of the outcome in the last two scenarios (plus the feasibility of the last scenario in which Bree actually takes things seriously) that creates Bree’s culpability.
Seriously, it’s not that complicated a case. What Bree has done is called “(criminal) recklessness” in the common law, and is absolutely culpable. Heck, it really is clear-cut that it was not malice nor negligience but precisely recklessness, how can one even argue that it was not?
